Privacy Policy
At Frenvexis S.A.S. ("Frenvexis", "we") we take the protection of your personal data as a core commitment. This Privacy Policy describes how we collect, use, store and share your information when you visit frenvexis.com or use our real estate crowdlending services in Argentina.
1. Data controller
The controller of your personal data is Frenvexis S.A.S., Tax ID 30-71864294-2, with registered office at Av. Leandro N. Alem 882, 14th floor, Autonomous City of Buenos Aires, Argentina. To exercise any right under Law 25,326 you can write to privacy@frenvexis.com.
2. Data we collect
We collect: (a) identification data (first name, last name, ID/Tax ID, date of birth); (b) contact data (email, phone, address); (c) financial data necessary to evaluate the investment (bank account, proof of origin of funds); (d) technical data (IP address, device type, browser, pages visited); (e) commercial data (projects you invested in, amounts, dates). All in accordance with Law 25,326 on Personal Data Protection.
3. Purposes
We process your data to: (i) enable you as an investor on the platform; (ii) comply with CNV and UIF (Resolution 21/2018) obligations regarding the prevention of money laundering; (iii) process your investments and returns; (iv) send you communications about available projects; (v) comply with legal, accounting and tax obligations; (vi) improve our services through statistical analysis.
4. Legal basis
The legal bases are: the consent you provide when registering, the performance of the investment contract, compliance with legal obligations (Law 27,349, Law 25,246, CNV GR 717/2017) and Frenvexis' legitimate interest in operating the platform and preventing fraud.
5. Retention
We keep your data for the duration of the contractual relationship and, once terminated, for a minimum period of 10 (ten) years according to the requirements of Law 25,246 and CNV regulations. Afterwards they will be deleted or anonymised.
6. Recipients
We may share your data with: the Argentine Securities Commission (CNV); the Financial Information Unit (UIF); the AFIP tax authority; banking entities involved; technology providers (hosting, KYC, digital signature) subject to confidentiality agreements; external auditors; and judicial or administrative authorities when a regulation so requires.
7. International transfers
Some of our technology providers are located outside Argentina (European Union, United States). Transfers are made to countries with an adequate level of protection or, failing that, by means of standard contractual clauses approved by the AAIP.
8. Data subject rights
Under Law 25,326 you have the right of access, rectification, update and deletion of your data. You can also withdraw your consent at any time. The AAIP (Public Information Access Agency) — the control body — is empowered to address complaints regarding non-compliance with the current regulations.
9. Security
We apply reasonable technical and organisational measures: encryption in transit and at rest, role-based access control, multi-factor authentication, continuous monitoring and periodic security audits. No system is completely infallible: we recommend that you protect your credentials.
